Is Airbnb Legal in Dubai? Rules for Owners and Tenants in 2026

Yes, Airbnb is legal in Dubai. But creating an Airbnb account is the easy part. The legal part comes with paperwork.

In Dubai, Airbnb properties are treated as holiday homes, a licensed activity regulated by the Department of Economy and Tourism (DET).

Your property needs a valid DET permit before you can list it. If you’re a tenant, you also need your landlord’s written consent to sublet the property.

At Homevy, we manage Dubai holiday homes and handle DTCM permit applications, renewals and appeals for the properties in our portfolio. We’ve been doing this for more than two years, so we know that compliance has to be maintained throughout the life of the property.

So, what do owners and tenants actually need to Airbnb their property legally in 2026? And what happens if you skip a step? Let’s get into it.

TL;DR: Is Airbnb Legal in Dubai in 2026?

  • Airbnb is legal in Dubai in 2026 as a “holiday home,” but only once DET has registered and approved the unit.
  • Owners register directly with DET and can hold up to 8 permits. More than that needs a licensed company.
  • Tenants need the landlord’s written consent under Dubai tenancy law, plus a DET permit backed by the owner’s authorisation.
  • A DET permit doesn’t override your tenancy contract, and an Airbnb account doesn’t replace the permit.
  • You can only let the whole unit. Private rooms aren’t allowed in Dubai residential properties.
  • Operating without a licence is fined AED 5,000. Repeat violations can double, up to AED 100,000, and unauthorised subletting can get you evicted.
  • Homevy handles permits, renewals and compliance for the Dubai homes we manage.

What Makes an Airbnb Legal in Dubai?

Airbnb is legal in Dubai when the property meets three requirements: DET approval, compliant property documents, and a valid permit number attached to the listing.

Think of it as three separate yeses:

  1. Does DET approve the property? Yes, if the unit meets the requirements and is issued a valid holiday home permit.
  2. Do your property documents allow it? Yes, if your title deed, Sale and Purchase Agreement (SPA) and, for tenants, your lease allow holiday-home use.
  3. Can you legally list it on Airbnb? Yes, once the property has its DET permit number and that number is included on the listing.

Under DET’s regulations and guidance, the property itself must also meet these requirements:

  • It must be an eligible apartment or villa in an authorised area.
  • Apartments need a Residential title deed.
  • Hotel rooms and hotel apartments cannot be registered as holiday homes.
  • The SPA must not explicitly prohibit holiday-home use.
  • You must rent the whole unit, not individual rooms or bed spaces.

So, thinking about listing that spare room in your Dubai Marina apartment? That’s a no.

Can Property Owners List Their Homes on Airbnb in Dubai?

Yes. If you own an eligible apartment or villa in Dubai, you can register as a Home Owner through DET’s Holiday Homes system and apply for a permit for each unit.

The name on your account must match the title deed, and individual owners can hold up to eight permits.

There are a few rules to know before you apply:

  • You must own the property: You can only apply for units registered in your name.
  • A family member can apply for you: A parent, child or spouse can register on your behalf, provided the application remains in your name and includes proof of the relationship.
  • You can hold up to eight permits: If you want to operate more than eight units, you’ll need a company licence or a licensed holiday home operator.
  • Permits are valid for one year: DET opens the renewal option 30 days before expiry, so don’t leave it until the last minute.

If you want to handle the application yourself, our guide to how to get a DTCM holiday home permit walks through the process, documents and fees.

If you’d rather have someone handle the compliance side, speak with a licensed property management company like Homevy. We can take care of the permit alongside the day-to-day management of your property.

Can Your Building or Developer Ban Airbnb?

Once DET has approved a property as a holiday home, developers, owners’ associations and property management companies have obligations around allowing licensed holiday homes to operate.

But that doesn’t mean every property automatically qualifies.

Three things can still get in your way:

  • Your Sale and Purchase Agreement (SPA): An explicit restriction on holiday-home use can prevent the property from qualifying.
  • Your location: DET only permits holiday homes in areas where the activity is authorised.
  • Your unit type: Hotel apartments are excluded from the holiday-home permit route.

Buildings can also have operating procedures for licensed holiday homes, including guest access and check-in requirements. So before you start buying furniture for your future Airbnb, read the SPA paperwork first.

What You Need to Do After Getting Your Permit

Getting your DET permit doesn’t mean you can forget about compliance and start counting bookings. Dubai’s holiday home regulations continue after your property goes live.

Once your permit is issued, make sure you:

  • Display your permit correctly: Keep the permit displayed inside the property and place its QR code under the DEWA plaque outside the door.
  • Check guests in through DET: Guest check-in must be recorded through DET’s system within three hours of arrival.
  • Collect the Tourism Dirham: The applicable Tourism Dirham must be collected based on your property’s classification.
  • Keep the required insurance: Your holiday home needs insurance that covers guest-related damage.
  • Maintain the property to its classification: Your furnishings, amenities and overall setup need to continue meeting the requirements for your holiday home classification.
  • Keep the permit current: Holiday home permits are valid for one year, so renewal needs to happen before expiry.

In other words, getting the permit is the beginning of your Airbnb compliance responsibilities, not the end.

Your holiday home also needs to meet the requirements for its classification, including the necessary furnishings and amenities.

Once the compliance side is clear, the next question is whether your rental income makes sense. Estimate your potential Airbnb income with our Airbnb income calculator, then compare it with what you could earn from a long-term lease using our STR vs LTR calculator.

Can Tenants List a Rented Apartment on Airbnb in Dubai?

Sometimes, but not without the landlord’s permission.

If you rent your Dubai apartment, your tenancy agreement gives you the right to live there. But it does not automatically give you the right to rent the property to Airbnb guests.

You need your landlord’s written consent, and the property still needs to meet DET’s holiday-home requirements.

Here’s how different situations affect your ability to list the property:

Your situation Can you list it?
Your landlord gives written consent Possibly, but you still need to meet DET’s requirements and obtain the necessary permit.
Your landlord says no No. You cannot legally sublet the property without the required consent.
Your lease prohibits subletting No. A DET permit does not override your tenancy agreement.
You want to operate several rented units You’ll need to look at the licensed operator/company route rather than treating them as personal Airbnb listings.

Renting apartments specifically to operate them as short-term rentals is a business model in its own right.

We cover the licensing, setup and numbers in our guide to Dubai’s subletting rules.

What Happens If You Airbnb a Rented Apartment Without Permission?

You can face consequences from DET, your landlord and Airbnb.

DET can fine you for operating without the required licence and close the unit. Your landlord can seek to evict you and your guests. Airbnb can also suspend or remove the listing.

1. Fines for Operating Without a DET Permit

DET’s fines are set out in Executive Council Resolution No. 49 of 2014 and its holiday homes guidance:

  • AED 5,000 for running a holiday home without a licence
  • AED 2,000 for leasing out without DET’s prior approval
  • AED 5,000 for providing false information to DET
  • AED 20,000 for operating while suspended
  • AED 500 for renting out separate rooms or bed spaces

Repeat the same violation within a year and the fine can double, up to AED 100,000.

DET can also suspend or cancel the permit and close the holiday home. If that happens, the operator must remove the property from advertising and deal with affected bookings.

2. Eviction for Unauthorised Subletting

An unauthorised sublet can breach Article 24 of Dubai’s tenancy law. Your landlord can apply for eviction through the Rental Disputes Center, and the eviction can affect both you and your guests.

3. Suspension or Removal from Airbnb

Airbnb requires Dubai hosts to provide a DET permit number. Hosts who don’t meet their responsibilities can have their listings suspended or removed.

So, yes, you might make some money from a few bookings.

Is it worth risking the apartment you live in?

How Homevy Keeps Dubai Holiday Homes Compliant

For every Dubai property we manage, we build compliance into the day-to-day operation.

Our process covers:

  1. Permit setup: We handle the DTCM permit application and make sure the property has the required classification before it goes live.
  2. Permit renewals: We track permit expiry dates and handle renewals before they expire and become a problem.
  3. Ongoing compliance: We keep an eye on the requirements that apply after the property is live, from guest check-ins to the property’s classification and required standards.
  4. Changes and cancellations: If the property or its operating status changes, we handle the relevant permit updates, cancellations and appeals.
  5. Guest operations: Compliance has to work alongside the guest experience. Our team manages the day-to-day operation so owners aren’t left tracking every requirement themselves.

That’s the point of having a property management company. You’re not just handing someone the keys. You’re handing over the operational details that keep the property running properly and generating rental revenue.

At Homevy, we’ve hosted 10,000+ guest nights across our Dubai portfolio, with a 4.9-star average guest rating, Airbnb Superhost status and about 91.1% average occupancy across managed properties.

It’s also why the Arabian Best of the Best Awards named Homevy the Best Short-Term Rental Management Company in Dubai for 2026.

Frequently Asked Questions About Airbnb Rules in Dubai

1. Can I Airbnb just a room in my Dubai apartment?

No. DET only permits whole units, and fines AED 500 for renting out separate rooms or bed spaces.

Airbnb also states that private and shared rooms aren’t allowed in Dubai residential properties. Long-term room sharing falls under a different regime altogether: Law No. 4 of 2026 on shared housing, run by Dubai Municipality.

2. Is Airbnb allowed in Dubai apartments?

Yes, if the apartment is in a residential building, has a “Residential” title deed, sits in an area DET authorises, and its SPA doesn’t ban holiday-home use. Hotel apartments can’t be permitted as holiday homes.

3. Can a landlord stop a tenant from listing on Airbnb?

Yes. Without the landlord’s written consent, a tenant can’t legally sublet under Dubai tenancy law. The landlord can also seek eviction if a tenant lists the unit anyway.

4. How many properties can I Airbnb in Dubai as an individual?

Up to eight at one time. Beyond that, DET requires a company licence, or you hand the extra units to a licensed holiday home operator.

5. Do I need a DET permit if I only host while I’m travelling?

Yes. DET’s guidance has no exemption for occasional hosting: apartments and villas must be registered and approved before they’re listed, and Airbnb asks for the permit number.

6. Can Homevy get the DET permit for me?

Yes, for the properties we manage. We handle the application, classification, renewals and appeals, then run the guest side so the unit stays compliant and booked. See how Homevy’s Dubai property management works.
